I. General Terms and Conditions

§ 1 Scope and Definitions

  1. The following terms and conditions apply to all contracts concluded between you and us as the provider (Arazhul Shop GmbH) via the website shop.arazhul.de.

  2. Conflicting or deviating terms and conditions of the customer shall not apply unless we have expressly agreed to their validity in writing.

  3. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.
    An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a contract, acts in the exercise of their commercial or independent professional activity.

§ 2 Subject Matter of the Contract

  1. The subject of the contract is:

  • the sale of goods, and

  • participation in a pre-order / interest confirmation model (hereinafter referred to as a “campaign”) for products that have not yet been produced.

  1. Campaigns are conducted on the “Yourplush” product page.

  2. “Yourplush” is a brand and product of Arazhul Shop GmbH.
    The customer’s contractual partner is exclusively Arazhul Shop GmbH. No contractual relationship arises with any third-party platform or brand.

  3. Campaign products are not immediately deliverable goods, but products whose production depends on reaching a defined minimum number of supporters.

§ 3 Pre-Order and Campaign Model (“Crowdfunding-like”)

  1. For certain products, we offer the possibility to submit a non-binding expression of interest (“petition”) by paying an amount of €2.00.

(2) Petition Phase

During the petition phase, it is determined whether sufficient interest exists.

The customer may request a refund of their payment at any time without giving reasons, as long as the petition has not yet been converted into a campaign.

(3) Campaign Start

As soon as at least 200 supporters have completed the pre-order, the petition will be converted into a binding campaign.

With the start of the campaign, a binding purchase contract is concluded.

(4) No Withdrawal After Campaign Start

Once the petition has been converted into a campaign, a refund of the pre-order amount is excluded.

The customer expressly agrees that once the campaign begins, production preparations will start and the amount will be used to finance the production.

(5) Production and Delivery

Production begins after the campaign starts.

The delivery time is approximately 1–3 months, unless otherwise stated in the offer.

Delivery delays due to production, material procurement, or logistics remain reserved.

(6) Campaign Failure

If the required minimum number of supporters is not reached, no contract will be concluded.

Any payments already made will be fully refunded.

§ 4 Conclusion of the Contract

  1. The presentation of products constitutes a binding offer.

  2. The contract is concluded via the online shopping cart system once the customer completes the ordering process and clicks the button containing a clear payment notice.

  3. For campaign products, § 3 of these terms and conditions applies additionally.

  4. Order processing takes place automatically via email. The customer must ensure that the provided email address is correct.

§ 5 Right of Withdrawal

  1. Consumers generally have a statutory right of withdrawal.

  2. Deviation for campaign products

The customer expressly agrees that:

  • withdrawal is possible before the campaign starts,

  • no right of withdrawal exists after the campaign starts, as the goods are individually planned and produced (§ 312g (2) No. 1 German Civil Code – BGB analogously).

  1. This consent is explicitly requested during the order process.

§ 6 Retention of Title

The goods remain our property until full payment has been made.

§ 7 Warranty

  1. The statutory warranty rights for defects apply.

  2. Obvious defects should be reported to us as soon as possible, although this is not a prerequisite for asserting warranty rights.

§ 8 Liability

  1. We are fully liable for intent and gross negligence.

  2. In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations).

  3. Liability is limited to the foreseeable damage typical for the contract.

§ 9 Choice of Law and Jurisdiction

  1. German law shall apply while preserving mandatory consumer protection provisions.

  2. The place of jurisdiction is our registered office, provided the customer is a merchant.

3. Prices and Payment Conditions

All prices are total prices including statutory VAT, plus shipping costs where applicable.

4. Delivery Conditions

The delivery time for campaign products is approximately 1–3 months after the start of the campaign.

5. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
